Terms of Use

1. About the Service

• The Service is a diary app that helps you keep and look back on your notes, written or spoken, and conversations with an AI.
• The AI in the Service is not a person. The Service is a tool for sorting out your thoughts and for personal growth. It does not provide medical care, diagnosis, treatment or counselling.
• If you are unwell in body or mind, please talk to a doctor or a professional support service. If your life or someone else’s is in danger, call your local emergency number (for example 911, 999, 112 or 000) at once. Support lines are listed in the app under Settings → “Where to get help”.

2. Who can use the Service

• You must be 13 or older. You enter your birth month when you sign up.
• If you are 13 to 15, you need the consent of a parent or guardian. We send an email to your parent or guardian, and you can use the Service once they agree. Where the law of your country sets a higher age for consent, that age applies.
• If you are 16 or 17, please tell a parent or guardian about the Service. Get their consent before subscribing to Mindrivo Plus.
• For users under 18, the AI follows extra rules so that its answers suit their age (section 5).
• People under 13 cannot use the Service. If we learn that an account belongs to someone under 13, or that the birth month is false, we may suspend the account.
• People whose use was stopped before for breaking these Terms may not be able to use the Service.

3. Your account

• You can create an account with Apple, Google, or an email address (a code, or a password).
• Only you may use your account. Keep the devices, email address and password you sign in with safe. Do not use a password you use for other services.
• If you notice that someone else is using your account, contact us at once.

4. Your records and your rights

• The notes, conversations, photos, recordings and other content you create (“records”) belong to you.
• You allow us, free of charge, to use your records only as far as needed to provide the Service (including storing, showing and backing them up, and sending them to make AI conversations, organizing and reviews). This permission ends when you delete the records or when the deletion of your account is complete.
• We do not use your records to train AI, and we send them to AI providers only on the condition that they do not train on them either.

5. About the AI’s answers

• The AI’s answers, organizing and reviews are made automatically and may contain mistakes. For important matters such as health, money or law, talk to a professional and decide for yourself.
• Before you use the AI features for the first time, the app shows what is sent to the AI provider (Anthropic, PBC, in the United States) and asks for your consent. Without it, you can still write and read your notes. You can stop or restart sending at any time under Settings → “Use AI features”.
• In conversations with users under 18, the AI does not engage with romantic or sexual topics or with ways to do dangerous things (such as extreme dieting, drugs or self-harm), and it suggests talking to a trusted adult or a support line.

6. What you must not do

• Anything against the law or public order
• Pretending to be someone else, or using someone else’s account
• Entering false information, such as a false birth month
• Putting excessive load on the Service or its servers, or accessing them without permission
• Analysing or copying the Service to make a similar service
• Trying to make the AI produce illegal content or content that hurts others
• Anything similar to the above

7. Prices and Mindrivo Plus

• The basic features (notes, speaking to write, conversations with the AI up to the number shown in the app, and weekly reviews) are free.
• With the paid plan “Mindrivo Plus” (monthly or yearly), there is no limit on AI conversations, and you can use “Think it through”, show photos to the AI, add recordings to notes, and more. The price is the one shown in the App Store for your country, including any applicable taxes, and is shown in the app before you subscribe.
• If you subscribe for the first time, the first week is free (once per Apple ID). When the free week ends, the price of the plan you chose is charged automatically. If you cancel at least 24 hours before the free week ends, you are not charged.
• Mindrivo Plus renews automatically. Unless you cancel at least 24 hours before the renewal date, it renews for the same period at the same price, charged to the payment method of your Apple ID. If the price changes, we tell you in advance through Apple’s process.
• You can cancel at any time in iPhone Settings → your name → “Subscriptions”. After cancelling, you can use Mindrivo Plus until the end of the period you paid for.
• Payments and refunds go through the App Store, and Apple’s Media Services Terms and Conditions apply. Refunds follow Apple’s rules. Nothing in these Terms limits any right to cancel or to a refund that the law of your country gives you.
• Deleting your account does not cancel your App Store subscription. Please cancel it before deleting your account.

8. Suspension

• We may, after telling you, stop all or part of your use of the Service or delete your account if any of the following applies. In an emergency, we tell you afterwards.
• (1) You break section 6. (2) What you registered (including your birth month) is false. (3) For users aged 13 to 15, the parent or guardian does not consent or withdraws consent. (4) A payment was made fraudulently.
• Even then, as far as the law allows, we give you a chance to export your records.

9. Deleting your account

• You can delete your account at any time in the app’s Settings. The account of a user aged 13 to 15 can also be deleted at the request of the parent or guardian.
• In case of a mistake, we keep the account and records for 30 days after the request; during that time you can restore them. After 30 days they are deleted for good and cannot be restored.
• Before deleting, you can export your records.

10. Changes to the Service and ending it

• We may change what the Service offers after announcing it. For maintenance or failures, we may pause it without notice when unavoidable.
• If we end the Service, we announce it in the app or on the website at least 60 days before, and give you time to export your records.
• Once we decide to end the Service, we stop new subscriptions and renewals of Mindrivo Plus and keep providing it until the end of the periods already paid for.

11. Disclaimers and limits of liability

• We work to provide the Service safely, but we do not promise that it is free of faults or fits a particular purpose.
• If our breach of contract or unlawful act causes you damage, our liability is limited to the larger of what you paid us for the Service in the 12 months before the cause arose or 10,000 yen, except in cases of intent or gross negligence.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you (for example, for death or personal injury caused by negligence, or your rights as a consumer).

12. Changes to these Terms

• We may change these Terms in accordance with Article 548-4 of the Japanese Civil Code.
• We announce the new Terms and the date they take effect in the app or on the website at least 14 days before that date.
• For important changes, such as changes to your disadvantage, we ask for your consent again in the app. If you do not agree, you can no longer use the Service from that date, but you can still export your records.

13. Governing law and courts

These Terms are governed by the laws of Japan. The Tokyo Summary Court or the Tokyo District Court, depending on the amount, has exclusive jurisdiction in the first instance. If you are a consumer living in the European Union, the United Kingdom or another country whose law gives you mandatory protection, you keep that protection, including the right to bring a claim in the courts of where you live.
